Terms of Service

§1 Definitions

  • Personal Data Controller - shall mean Luxsfery Sp. z o.o.[Ltd.] with the registered office in Kraków (Cracow), Smoleńsk street, No. 20/6, 30-112 Kraków, entered into the National Court Register, for whom the District Court for Kraków – Śródmieście in Kraków keeps the records under the KRS number: 0000511031.
  • Email address of the User - shall mean an email account defined by the User in the Account.
  • Working Time of the Web Portal - shall mean a period in which LUXSFERY renders its services.
  • Business Day - shall mean a period from Monday to Friday, excluding Saturdays and Sundays as well as public holidays.
  • Account - shall mean a part of the Web Portal to which the User has been given an access by LUXSFERY and used in order to benefit from the rendered services as well as to gather information on the User’s activities within the Web Portal. The Account shall be available for the User if it has been successfully registered in the Web Portal as well as after it has been given its valid login and password.
  • Login - shall mean an email address given by the User while registering on the Web Portal.
  • Password - shall mean an unique data constituting a combination of letters, numbers or symbols determined by the User while registering in the Web Portal and allowing for the unique identification of the User as well as enabling the User to gain an access to the Account.
  • LUXSFERY - shall mean Luxsfery Sp. z o.o.[Ltd.] with the registered office in Kraków (Cracow), Smoleńsk street, No. 20/6, 30-112 Kraków, entered into the National Court Register, for whom the District Court for Kraków – Śródmieście in Kraków keeps the records under the KRS number: 0000511031.
  • Logistics Partner - shall mean FedEx company, which renders services related to goods delivery between LUXSFERY and the User. Conditions of carriage are available on the website of our Logistics Partner: www.fedex.com/pl/services/terms/
  • Products - shall mean any rendered and delivered by LUXSFERY via the Web Portal services, things or rights which may constitute the subject matter of the Transactions, including, inter alia:
  • a. contact with image consultants,
  • b. fashion advice,
  • c. personal styling of the User
  • d. ancillary services rendered for the Users that facilitate use of features and functionality of the Web Portal, but in particular:
  • I. activities, including provision of banner ads on the Web Portal,
  • II. provision of newsletters,
  • III. provision of a form for registering and logging in the Web Portal,
  • IV. services shall be rendered by electronic means, i.e. the Users shall have a possibility to browse around and use a chosen content and information as well as any features of the Web Portal; the Users shall be given an access to the form for registering and logging in the Web Portal; the User shall have a possibility to ask questions and contact with LUXSFERY specialist, by phone or e-mail.
  • Payment Partner - shall mean the owner of the website “Przelewy24”, who renders financial services for the Web Portal within the scope of wire transfers between the User and LUXSFERY via Internet. The payment scheme with the regulation is available on the website of our Payment Partner: www.przelewy24.pl
  • Web Portal - shall mean the on-line trading platform managed by LUXSFERY, both in English and Polish, and the access to it shall be secured; the Transactions shall be organized as well as other services related to Transactions shall be rendered via this Web Portal; the Web Portal shall be maintained by LUXSFERY on domains belonging to LUXSFERY.
  • Purchase Confirmation - shall mean an e-mail message confirming execution of the Transaction sent to the User’s email address.
  • Registration - shall mean a procedure of the Account opening.
  • Transactions - shall mean procedures of performance of sales agreements related to goods and services as stated in Article 5 hereof.
  • Mobile Devices - shall mean any devices of the User, in particular mobile phones, smartphones or tablets.
  • User - shall mean a natural person with full legal ability, who registered in the Web Portal, and as a result of such registration an individual Account has been set up for this person and such Account enables this Person to gain an access to all goods within the Web Portal business in accordance with the terms and conditions determined in the Terms of Service.

§2 General Provisions

1.

The Terms of Service define principals of use by the Users any services rendered by LUXSFERY via the Web Portal.

2.

Prior to registration the User has to read and understand the Terms of Service. Furthermore, the User, opening its Account on the Web Portal, hereby accepts the Terms of Service, and provisions hereof shall be binding for the User.

3.

We store the agreement content, and the further relevant details of your Transaction shall be send by email. The Terms of Service are free of charge as well as publicly available and may be downloaded any time. The detailed information on your last orders you may find logging into your Account on a domain belonging to LUXSFERY.

4.

All prices given on the Web Portal are in Polish currency (złoty) and such prices are gross prices (they include VAT tax).

5.

LUXSFERY hereby reserves the right to introduce new products to market, provided that such change does not affect the rights of persons who had concluded the agreement related to goods offered by the Web Portal before the above-mentioned change was implemented. The final price shall be confirmed to the User on the final order screen.

6.

All goods offered on the Web Portal are brand new and original.

§3 User - Registration, Rights and Obligations

1.

In order to use the services rendered by the Web Portal it is necessary to register in the Web Portal and to read and understand the Terms of Service as well as to make a declaration of intent related to acceptance of provisions of the Terms of Service by choosing the option „I accept the Terms of Service and Privacy Policy of LUXSFERY”.

2.

The registration means filling in the registration form which is placed on domains belonging to LUXSFERY, by providing:

  • first and name,
  • the User’s email address that shall constitute login (login shall not be changed),
  • password (the password must consist of minimum 6 characters),
  • mobile phone number.

3.

Within 24 hours after filling in the registration form, a message confirming registration as well as other required by the applicable provisions of law information shall be sent to the email address (Login) provided. As soon as the registration is confirmed, the agreement shall be concluded by and between the User and LUXSFERY, and the subject matter of this agreement shall be related to products and services delivered by LUXSFERY within the Web Portal business in accordance with terms and conditions determined in the Terms of Service.

4.

The User shall be obliged to enter a correct data.

5.

The User hereby accepts and agrees that the Web Portal shall not bear any responsibility for mistakes made by the User, in particular in case of mistakes related to invalid delivery address or contact number.

6.

The User shall be obliged to protect its Login and Password against unauthorized access of any third party, otherwise the User shall be solely and fully reliable for any damages arising out of such a negligence under the general provisions of law.

7.

If an unauthorized third party gains an access to any data that enable it to log into the Web Portal, including Login and Password, or if there is a reasonable suspicion that such registration may happen, the User should change its Password without any delay and inform on this LUXSFERY.

§4 Transactions

1.

During first logging into the Web Portal, the User shall obtain any and all necessary information on activity and functioning of the Web Portal.

2.

After completion of additional, but relevant for execution of orders data, i.e. size, type of clothes, specialist of LUXSFERY shall begin presentation of individually selected for the User products from available on the Web Portal offer, with color, size and other characteristics attributable for the products.

3.

The User, through an order form, has a possibility to contact with a specialist of LUXSFERY in a form chosen by the User – by phone or by email. Contact of a specialist of LUXSFERY via phone may be within three time intervals, i.e.:

  • From 9:00 a.m. to noon
  • From noon to 3:00.p.m.
  • From 3:00 to 6:00 p.m.

The User chooses the time interval.

4.

The User, from the products presented by LUXSFERY specialist, selects the goods he is truly interested in. Then the User confirms the order by clicking on the button "Go to checkout" and is redirected to the appropriate website of the Payment Partner in order to complete the Transaction.

5.

The Transaction may be completed during the whole year, 24/7, excluding technical breaks on which the Users shall be informed by a notification placed on domains belonging to LUXSFERY.

6.

LUXSFERY reserves the right to withdraw from the Transaction, if the User entered incomplete or invalid data which is relevant for execution of the order. LUXSFERY shall be obliged to inform immediately the User on each withdrawal from a given Transaction, giving the reason.

7.

An e-mail sent to the address stated in the order form, in which the number of products, the total value of the order, delivery and payment method as well as the User’s contact details are given, shall constitute a confirmation of an order placed by the User.

8.

After receipt of the above-mentioned confirmation the Transaction shall be concluded for the selected by the User products.

9.

The User shall be entitled to return the products or a make a potential complaint in accordance with § 7 and 8 of the Terms of Service.

10.

If delivery or receipt is delayed due to unjustified refusal of acceptance of the shipment by the User, or if the User does not accept the shipment or it does not take over the product from the Logistics Partner (within 7 business days since unsuccessful attempt of delivery of the product took place), LUXSFERY may (without prejudice to any rights or legal means to which it is entitled) impose additional fee for storage of the products as well as for other incurred by LUXSFERY reasonable costs, inform on withdrawal from the agreement with immediate effect as well as reimburse the paid by the User amounts related to the Transaction less the value of the abovementioned incurred costs.

§5 Methods of Payment

1.

The subject responsible for any and all payments shall be our Payment Partner –“Przelewy24”.

2.

Cards accepted are: Visa Classic, Visa Electron, MasterCard, JCB and Diners Club.

3.

The payment scheme with the regulations is available on the website: www.przelewy24.pl

§6 Shipping

1.

The Products shall be delivered to the address stated by the User in a given order.

2.

The standard time limit for delivery of a courier parcel is 1 business day counting from the next day after the parcel is sent. Commencement of execution of the order may be delayed until LUXSFERY’s bank account is credited with the amount due for the order.

3.

All shipments shall be executed in a form of the insured courier parcel.

4.

The orders shall be sent at cost of LUXSFERY. The purchase confirmation (at the discretion of the User, i.e. a receipt or a VAT invoice) shall be attached to each product sent to the User.

5.

The subject responsible for delivery of the products shall be our Logistics Partner – FedEx company.

§7 Withdrawal from the Agreement, Returns

1.

The User Service Agreement may be terminated by each party with 14-day notification period and with giving a reason of such termination.

2.

If the User breaches the provisions of law, the Terms of Service, rights of third party as well violates good practices, or if any of presentations of the User turns out to be untrue, inaccurate or misleading, LUXSFERY shall be entitled to the User’s Account with immediate effect.

3.

Rendering of services within the Web Portal shall be unlimited in time, subject to the provisions of the next sentence as well as provisions of item 5 below. The User may at any time terminate the agreement concluded with LUXSFERY (the agreement concerning the Account) sending to the following email address: service@luxsfery.pl information on intention of such termination. Then LUXSFERY shall deliver an appropriate termination form which, printed and signed by the User, has to be sent by mail to the address of LUXSFERY. With regard to the conditions specified in item 6 below, the agreement shall be terminated with immediate effect at the moment of confirmation of the data, provided that the User participates in the commenced prior to termination of the agreement Transactions under the terms and conditions of the Web Portal.

4.

Due to important reasons the agreement may be terminated by LUXSFERY with 7-day notification period, subject to the provisions of item 2 above.

5.

If the agreement was terminated upon a decision of LUXSFERY, the User shall not be allowed to register again on the Web Portal without a prior consent of LUXSFERY.

6.

Termination of the agreement or closing the Account by the User shall not affect the concluded Transactions as well as arising out of such Transactions settlements between LUXSFERY, the Payment Partner and an individual User.

7.

The User shall be entitled to withdraw from the Transaction concluded with LUXSFERY at a distance by means of declaration made to LUXSFERY in writing or by email, pursuant to the rules laid down in the Act of 2 March 2000 year on protection of certain consumer rights and liability for damage caused by a hazardous product (The Official Journal of Laws of 2000 No. 22, item 271), but the User may withdraw from the Transaction within 14 days after delivery of the goods.

8.

The User shall not be entitled to the right of withdrawal from the distance agreement in the following cases:

  • a. If a service commenced on the expiry of 14 days from delivery of the goods;
  • b. In case of services with the characteristics specified by the User in the order placed by the User or strictly connected with the User (for example a tailor-made product);
  • c. In case of services which by their nature can not be returned or if they subject to rapid deterioration;

9.

In case of withdrawal from the sales agreement, the parties hereto shall be obliged to return each other the subject matter of their services in the unaltered state. Such return shall be as soon as possible, not later than within the time limits provided for by provisions of applicable law. The products returned by the User can not be destroyed or stained in any way. Furthermore, such Products can not bear traces of use, i.e. any smell, but what it is most important, the product should have a price tag in its original place. The User should be careful during trying on clothes (the underwear can not be tried on!!) in such a way as not to damage/destroy clothes and not to scratch shoes.

10.

In order to withdraw from the sales agreement as well as to return the products, the User should use its Account and fill in the return form.

11.

The User shall return the product using services rendered by our Logistics Partner after receiving a return label from LUXSFERY.

§8 Complaints

1.

The User may make complains in relation to each product purchased on the Web Portal, provided that the time limits as well as terms and conditions of complaints shall be in accordance with appropriate provisions of law, if such product has defects that constitute a case of non-compliance with the concluded Transaction.

2.

The complaint may be submitted in writing and sent to the following address: LUXSFERY Sp. z o.o., ul. Smoleńsk 20/6, 31 - 112 Kraków. The complaint shall be investigated by LUXSFERY within 30 days counting from the day of its delivery. The notification of results of this investigation shall be made by mail sent to the address stated by the User, who submits the complaint, or by email to the email address given by the User within 7 days since the investigations is made by LUXSFERY.

3.

LUXSFERY refuses to honor a complaint, if the product (s) is (are) destroyed or stained in any way, bear(s) traces of use or does (do) not have a price tag in its/their original place.

4.

If the complaint is not accepted, the product (s) shall be returned to the User at its cost with an information that the complaint is unjustified.

5.

If the product has any defects, the User shall be entitled to the following legal claims pursuant to Art. 556 and Art. 561 of the Civil Code:

  • the User may submit a declaration of withdrawal from the agreement or ask for reducing the product price, unless the Seller, without undue delay or inconvenience for the Purchaser, replaces the goods with defect-free products or removes such defect,

or

  • the User may ask for replacement of the product with a defect-free one or ask for removal of such defect.

6.

All questions related to functioning of LUXSFERY shall be sent to the email: service@luxsfery.pl

§9 Privacy and Confidentiality

1.

The personal data entrusted by the Users shall be gathered and processed by LUXSFERY in accordance with applicable law as well as with the policy on data privacy described in “Privacy Policy” document.

2.

The User shall have an access to the personal data of other Users only in cases provided for under the Terms of Service as well as in other reasonably justified cases, upon a prior consent of the data subject.

3.

The completed Transactions shall be published in the User’s Account. LUXSFERY ensures and guarantees a complete and complex public disclosure of information on the completed Transactions.

4.

LUXSFERY shall pay particular attention to ensure confidentiality for the Users. LUXSFERY shall, with due diligence, apply adequate technical and organizational means to provide security for the processed data, including protection related to programming, inter alia, as data encryption systems.

5.

Above all, the LUXSFERY shall protect the data against access by unauthorized persons as well as against unlawful processing of the data. LUXSFERY shall maintain continuous control over the data processing and shall, as far as possible, restrain access to the data by giving access permissions only when indispensible for proper running of the Web Portal.

6.

Data set related to the Users was given to the Inspector General for Protection of Personal Data in order to be registered and has been entered into the national registry of personal data sets. The data controller is LUXSFERY.

7.

The basis for processing of the personal data is a consent of the Users as well as a statutory authorization to process data for conclusion of the service agreement with LUXSFERY and performance as well as settlement of the services rendered by LUXSFERY in the frame of the Web Portal.

8.

Provision of any personal data by the User is completely voluntary; however, provision of the abovementioned data is required for conclusion of the agreement with LUXSFERY in relation to performance of the services in the frame of the Web Portal. In case of registering by Facebook.com or Linkedin or Google+, the mentioned above data, upon a consent of the User, shall be collected by LUXSFERY from one of the mentioned services. Persons visiting the Web Portal may review the offers related to the products placed on the Web Portal without a prior registration as well as without giving the personal data.

9.

Data entrusted by the User during registration process shall be used for book-keeping purposes, for maintaining contact with the User in connection with activities of the Web Portal and for other activities related to conclusion as well as performance of the service agreement in the frame of the Web Portal. The current data of the User, that is mentioned in the previous sentence, may be used to verify whether the registered person meets conditions required by the applicable law. Contact data, upon a consent of the User, may also be used for providing the User by LUXSFERY with information on the company and on services rendered by this company. The User may, at any time, resign from being furnished with this type of information.

10.

In addition, occasionally on the basis of questionnaires sent by e-mail or available directly on the Web Portal, upon a consent of the User, LUXSFERY shall collect from the Users any demographic and profile data (as education, age, opinions). Such data shall be used for research purposes of the Users preferences as well as in order to adapt LUXSFERY’s offer to their expectations, and the data shall also be used for statistical analysis and creating of a collective image of the Users that shall be delivered to marketing partners of LUXSFERY. Disclosure of such data shall be always voluntary, and the User may, at any time, resign from being furnished with this type of questionnaires.

11.

The Users’ data may be shared with entities authorized to receive it under applicable law, including with competent judicial authorities. The Users’ personal data may be shared with any third parties in the specific case proposed by the LUXSFERY and upon a consent of the User.

12.

If LUXSFERY obtains information that the User uses the Web Portal unlawfully, LUXSFERY may process the User’s personal data to the extent necessary to determine its responsibility, provided that it shall register for purposes of evidence a fact of obtaining such information as well as its content.

13.

LUXSFERY shall ensure execution of the Users’ rights resulting from Personal Data Protection Act ; this particularly includes the right to review and correct own personal data, the right to control processing of its own personal data as provided for in the provisions of the Act. As part of the right to control the processing of own personal data, the Users shall, in particular, have the right to submit – in the events determined in Personal Data Protection Act – a written, well-motivated request to cease processing of the personal data, on grounds relating to particular situation of the User, as well as the User shall have the right to object to processing of its personal data, if LUXSFERY intends to process such data for marketing purposes or in case of delivering by LUXSFERY personal data to other than LUXSFERY data controller

14.

LUXSFERY shall ensure the Users a possibility to review and modify the personal data on the terms and conditions determined by LUXSFERY. LUXSFERY shall ensure the Users a possibility to remove its personal data from the data base, if the User withdraws from the agreement as well as in other cases, if it arises out of the applicable law. LUXSFERY shall be entitled to refuse removing of the User’s data exclusively in cases determined by the applicable law, but in particular, if the User fails to pay all amounts due to LUXSFERY or if LUXSFERY obtains and records information that the User, by its behaviour on the web portal, breached the principles related to using of such web portal or violated the applicable provisions of law, and maintaining of such data is necessary to clarify these circumstances as well as clarify responsibility of the User.

15.

LUXSFERY may use IP addresses obtained during internet connections for technical purposes related with administering the servers. Besides, the IP addresses may be used for collecting general, statistical demographic information (e.g. on region from which the contact was made). Such information may also be connected with the data entrusted by the User in order to render services related to using of the Web Portal.

16.

LUXSFERY shall use "Cookies" files. Information obtained from "Cookies" enables to adapt the services and contents to individual needs and preferences of the Users and serve to prepare general statistical information on use of the Web Portal by the Users. Disabling the „Cookies” in web browser generally does not preclude use of the Web Portal, however may cause some difficulties. More detailed provisions related to “Cookies” shall be determined by the document entitled „Cookies Policy”.

§10 Consent for Processing of the Personal Data

1.

By opening the Account the User gives its consent for processing of its personal data by the Personal Data Controller, but in particular its first name, last name, phone number and full address for purposes related to the execution of the order. Thus, the User gives it consent for sharing its personal data with any entities collaborating with LUXSFERY exclusively for purposes related to execution of the order.

2.

The User hereby gives its consent to have commercial information sent through email by LUXSFERY, pursuant to the Act on Providing Services by Electronic Means of 18 July 2002 (The Official Journal of Laws 2002, No. 144, item 1204 as amended).

3.

The User hereby gives its consent to have advertisements sent by email or mail by LUXSFERY’s partners. The partners of LUXSFERY may use this data solely for purposes related to delivery of a parcel to the post or email address and they shall not be entitled to share this information with any third parties.

4.

The User may withhold the above-mentioned consent, in whole or in part, subject to item 2.

5.

The consent cancellation shall be sent to the address of the registered office of LUXSFERY.

§11 Rejestracja 100 PLN

Przysługiwany rabat nie podlega zamianie na równowartość pieniężną.

Klient uaktywnia promocje przy zakupach za minimum 1000 PLN. Klientowi udzielany jest rabat naliczany od aktualnej ceny detalicznej produktu zgodnie z zasadami określonymi w niniejszym Regulaminie. Towary, które zostały zakupione w ramach promocji, mogą zostać zwrócone na zasadach określonych przez luxsfery.pl

7.

W przypadku zwrotu towarów zakupionych w ramach tej promocji, Klient otrzymuje zwrot wartości produktu widniejący na paragonie dostarczonym razem z przesyłką

§11 Final Provisions

1.

The Web Portal shall be available for the Users 24/7, excluding periods of necessary technical breaks. When the Web Portal is available, the Users may use the products offered by LUXSFERY. The User hereby accepts and understands that the time of availability of the Web Portal is not equal to business hours of its employees.

2.

Use of the information presented on the Web Portal or use of mobile applications, other software/plugs should not be construed as acquisition of any intangible goods rights to materials or databases or other elements protected by intellectual property rights presented there and available solely within the scope of use of the Web Portal by the User.

3.

The Terms of Service constitute a part of the agreement concluded by and between LUXSFERY and the User. The content of the Terms of Service shall be binding in accordance with its original wording at the moment of placing of the order by the sUser.

4.

Any disputes arising out of and in connection with performance of the product sales agreements concluded by the parties hereto shall be in the first instance determined through negotiations with an intend to bring it to an end by amicable settlement of the dispute.

5.

To all matters not settled herein appropriate applicable provisions of law shall apply.

6.

LUXSFERY may make amendments to the Terms of Service as well as implement a new version of services rendered under the Web Portal. Such amendment shall be effective within the time limit stated by LUXSFERY, and such time limit can not be shorter than 7 days since the modified Terms of Service are available on the Web Portal, provided that the Transactions commenced before the modified Terms of Service become effective shall be executed in accordance with previous, unchanged terms and conditions.

7.

The User, during first logging into the Web Portal since such amendments became effective, shall be informed on any changes as well as on a possibility to accept these changes. Refusal of consent for such amendments shall mean termination of the agreement concluded with LUXSFERY with an effect determined in § 7 item 4 hereof.

8.

The User of the Web Portal shall be obliged to:

  • refrain from submitting and communicating any content that is forbidden by the applicable law,
  • use the Web Portal in a way not distorting work of this Web Portal,
  • not to use the Web Portal in a way which is inconvenient for other Users as well as for LUXSFERY.
  • use information placed on the Web Portal for private use.

How to place an order?

You can place an order by either contacting your stylist directly, by phone or e­mail or using your user account. If you choose to contact your stylist by phone or e­mail, briefly explain your needs and preferences, just so your stylist gets an idea of what you are looking for.

If you decide to use your account, go to ‘Request a Luxbox’ and from the list of clothing elements choose the pieces you would like to get. Then choose the date, when you would like your stylist to contact you, and if you wish add some comment in the comment box. Your stylist will contact you to elaborate more on your needs.

Will I get to see my items before shipping?

Yes. You will get a preview of all items selected by your stylist in your account under ‘My Luxsfery’. It is very important for us that you are fully aware and satisfied with your purchase.

How do I choose the pieces of wardrobe I need?

In your account under ‘Request a Luxbox’ you will see a list of icons that correspond to the wardrobe elements. Choose the elements you would like to get, and confirm it on the bottom of the page. Your stylist will get your request and start working on it, by contacting you first on the day you selected.

Is there a minimum purchase required?

No, there is no minimum purchase. However, keep in mind, that we offer comprehensive styling services for free, so it is for your benefit to fully take advantage of that opportunity.

Can I pick up my order in person?

Currently, we don’t offer walk­-ins, so pick up in person is not possible.

Are there any styling fees?

No, there are no styling fees. All styling services are free of charge.

When will my stylist contact me for the first time?

Your stylist will contact you right after your registration is completed. Depending on the day and time, it might take up to one working day to get back to you. This first conversation is very crucial, because your stylist would like to get to know you well, in order to better serve you.

When do I pay for the services?

Luxsfery Men’s Club members don’t pay for any services. You only pay for clothes, after the acceptance of selected items.

Are there any service fees at Luxsfery?

There are no extra charges, no fees and no obligations. Membership and personal styling services are free.

What are the payment methods?

Our partner Przelewy24 ensures various methods of safe payments, starting from automatic bank transfers to card payments. Cards accepted: Visa Classic, Visa Electron, MasterCard, JCB and Diners Club.

What are the clothing prices?

We offer clothes priced for every budget and spending preferences. Our prices are within the following ranges: shirts (120­ 600zł), jackets (350 – 1800zł), pants (150zł – 900zł), shoes (200zł – 1500zł).

How can I return my items?

If something didn’t meet your expectations, you can return it within 14 days. Simply go to your account, click on orders, choose the order number and select items you want to return. Add the pick up address, from where the courier will pick up your return. Follow the packaging instructions.

You have 14 day from the time you received the package to make a return.

Properly fitted clothes define a well dressed man. Whether it be a formal or casual wear, right fit makes a big difference in the appearance of the entire outfit. To ensure accurate measurements, have someone to help you, and remember to take measure over bare skin or your underwear, with your muscles relaxed. The tape measure should be tight enough so it does not slip down, but never so tight as to restrict breathing.

The hip measurement is taken as a circumference measurement
around the widest part of your hips and buttocks.
Neck size
Wrap the tape around your neck, right below your Adam’s apple.
The tape should be comfortably touching the skin. Put a finger
between the tape and the neck for a more loose fir collar.
Chest size
Measure around the widest part of your chest, beneath your armpits,
right across the nipples. Hold the tape tight enough so that it
does not slip down, but not so tight that it restricts breathing.
Waist size
Put the tape around your natural waistline, which should be close
to your bellybutton. Put one finger between the tape and your body
to ensure maximum comfort.
Outseam Length
Stand upright, do not bend the leg. Measure from the waistband
along the outside seam to the bottom of the leg.
Inseam Length
Stand upright, do not bend the leg. Measure from the lowest
part of your crotch along the inner side of the leg straight
down to the lower part of your ankle.

Privacy Policy

LUXSFERY shall pay particular attention to ensure confidentiality of the Users. LUXSFERY shall, with due diligence, apply adequate technical and organizational means to provide security for the processed data, including protection related to programming, inter alia, as data encryption systems. Above all, the LUXSFERY shall protect the data against access by unauthorized persons as well as against unlawful processing of the data. LUXSFERY shall maintain continuous control over the data processing and shall, as far as possible, restrain access to the data by giving access permissions only when indispensible for proper running of the web portal.

Data set related to the Users was given to the Inspector General for Protection of Personal Data in order to be registered and has been entered into the national registry of personal data sets. The data controller is LUXSFERY.

The basis for processing of the personal data is a consent of the Users as well as a statutory authorization to process data for conclusion of the service agreement with LUXSFERY and performance as well as settlement of the services rendered by LUXSFERY in the frame of the web portal.

Provision of any personal data by the User is completely voluntary; however, provision of the mentioned in § 9 of the data is required for conclusion of the agreement with LUXSFERY in relation to performance of the services in the frame of the web portal. In case of registering by Facebook.com or Linkedin or Google, the mentioned above data, upon a consent of the User, shall be collected by LUXSFERY from one of the mentioned services.

Data entrusted by the User during registration process shall be used for book-keeping purposes, for maintaining contact with the User in connection with activities of the web portal and for other activities related to conclusion as well as execution of Transaction in the frame of the web portal. The current data of the User, that is mentioned in the previous sentence, may be used to verify whether the registered person meets conditions required by the applicable law. Contact data, upon a consent of the User, may also be used for providing the User by LUXSFERY with information on the company and on services rendered by the company. The User may, at any time, resign from being furnished with this type of information.

In addition, occasionally on the basis of questionnaires sent by e-mail or available directly on the web portal, upon a consent of the User, LUXSFERY shall collect from the Users any demographic and profile data (as education, age, opinions). Such a data shall be used for research purposes of the Users preferences as well as in order to adapt LUXSFERY’s offer to their expectations, and the data shall also be used for statistical analysis and creating of a collective image of the Users that shall be delivered to marketing partners of LUXSFERY. Disclosure of such a data shall be always voluntary, and the User may, at any time, resign from being furnished with this type of questionnaires.

The Users’ data may be shared with entities authorized to receive it under applicable law, including with competent judicial authorities. The Users’ personal data may be shared with any third parties in the specific case proposed by the LUXSFERY and upon a consent of the User.

If LUXSFERY obtains information that the User uses the web portal unlawfully, LUXSFERY may process the User’s personal data to the extent necessary to determine its responsibility, provided that it shall register for purposes of evidence a fact of obtaining such information as well as its content.

LUXSFERY shall ensure execution of the Users’ rights resulting from Personal Data Protection Act ; this particularly includes the right to review and correct own personal data, the right to control processing of its own personal data as provided for in the provisions of the Act. As part of the right to control the processing of own personal data, the Users shall, in particular, have the right to submit – in the events determined in Personal Data Protection Act – a written, well-motivated request to cease processing of the personal data, on grounds relating to particular situation of the User, as well as the User shall have the right to object to processing of its personal data, if LUXSFERY intends to process such data for marketing purposes or in case of delivering by LUXSFERY personal data to other than LUXSFERY data controller.

LUXSFERY shall ensure the Users a possibility to review and modify the personal data on the terms and conditions determined by LUXSFERY. LUXSFERY shall ensure the Users a possibility to remove its personal data from the data base, if the User withdraws from the agreement as well as in other cases, if it arises out of the applicable law. LUXSFERY shall be entitled to refuse removing of the User’s data exclusively in cases determined by the applicable law, but in particular, if the User fails to pay all amounts due to LUXSFERY or if LUXSFERY obtains and records information that the User, by its behavior on the web portal, breached the principles related to using of such a web portal or violated the applicable provisions of law, and maintaining of such data is necessary to clarify these circumstances as well as clarify responsibility of the User.

LUXSFERY may use IP addresses obtained during internet connections for technical purposes related with administering the servers. Besides, the IP addresses may be used for collecting general, statistical demographic information (e.g. on region from which the contact was made). Such information may also be connected with the data entrusted by the User in order to render services related to using of the web portal.

LUXSFERY shall use "Cookies" files. Information obtained from "Cookies" enables to adapt the services and contents to individual needs and preferences of the Users and serve to prepare general statistical information on use of the web portal by the Users. Disabling the „Cookies” in web browser generally does not preclude use of the web portal, however may cause some difficulties.
